Terms & Conditions

NurtureEd will take reasonable care when assessing candidates, but the final decision to employ or engage a candidate rests with the family.

2. Candidate checks

NurtureEd conducts appropriate checks before introducing candidates to families.

Depending on the role, these may include:

  • Identity verification;

  • Right-to-work checks;

  • Enhanced DBS checks where the role is eligible;

  • Children's Barred List checks where legally applicable;

  • References;

  • Employment-history checks;

  • Qualification verification;

  • Professional-registration checks where applicable;

  • Paediatric first-aid verification; and

  • Other relevant safeguarding checks.

A DBS check, reference or qualification does not guarantee a candidate's future conduct or suitability.

3. The family's responsibilities

Before employing or engaging a candidate, the family is responsible for satisfying itself that the candidate is appropriate for its particular circumstances.

The family is responsible for:

  • Agreeing duties and responsibilities;

  • Agreeing working hours;

  • Agreeing salary or fees;

  • Entering into appropriate employment or engagement terms;

  • Complying with applicable employment law;

  • Making appropriate PAYE, National Insurance and pension arrangements where applicable;

  • Providing a safe working environment;

  • Providing appropriate insurance; and

  • Complying with its safeguarding responsibilities.

Where the family directly employs a nanny or tutor, NurtureEd is not the employer.

4. Placement fee

NurtureEd charges a 12% placement fee based on the candidate's gross first-year salary.

For example:

Annual salary: £50,000
NurtureEd placement fee: £6,000

The placement fee is calculated using the candidate's agreed gross annual salary at the commencement of the placement.

Where the agreed remuneration includes guaranteed bonuses, guaranteed allowances or other guaranteed payments forming part of the candidate's first-year remuneration, NurtureEd may include these in the fee calculation.

Discretionary bonuses and expenses are excluded unless otherwise agreed.

VAT

NurtureEd does not currently charge VAT on its placement fee.

Should NurtureEd's VAT status change, NurtureEd reserves the right to charge VAT where legally required, subject to applicable law.

5. When the placement fee becomes payable

The placement fee becomes payable when the family employs or engages a candidate introduced by NurtureEd.

This includes where the family:

  • Employs the candidate directly;

  • Engages the candidate on a self-employed basis where lawful;

  • Engages the candidate through another person or entity; or

  • Engages the candidate for substantially the same services following an introduction by NurtureEd.

The fee remains payable if the family initially decides not to proceed with a candidate but subsequently engages that candidate following the NurtureEd introduction.

6. Introduction protection period

A candidate introduced by NurtureEd remains protected by NurtureEd's introduction fee for 12 months from the date of introduction, unless otherwise agreed in writing.

If the family employs or engages that candidate during this period, the applicable placement fee remains payable.

7. Three-month replacement guarantee

NurtureEd provides a three-month replacement guarantee on permanent nanny and tutor placements.

Where the placement ends within the first three months because the candidate resigns or the family terminates the placement due to the candidate's unsuitability, NurtureEd will make reasonable efforts to identify a suitable replacement candidate without charging a second placement fee.

The replacement guarantee is subject to the following conditions:

  • The original placement fee has been paid in full;

  • The family notifies NurtureEd promptly when the placement ends;

  • The family has complied with the agreed employment terms;

  • The family has paid the candidate correctly and on time;

  • The family has provided a safe and appropriate working environment;

  • The termination is not primarily caused by a material change in the family's requirements;

  • The family has not materially changed the role, hours, location or salary without agreement;

  • The family has not dismissed the candidate for discriminatory or otherwise unlawful reasons; and

  • The family cooperates reasonably with NurtureEd in considering replacement candidates.

The replacement guarantee provides for a replacement search, not a cash refund of the original placement fee.

If NurtureEd is unable to provide a suitable replacement, the parties may discuss an appropriate alternative arrangement.

8. Changes to the role

If, following introduction, the family materially changes:

  • The salary;

  • Working hours;

  • Duties;

  • Location;

  • Live-in/live-out arrangement; or

  • Other fundamental terms,

the family should notify NurtureEd.

A material change may affect candidate suitability and the replacement guarantee.

9. Candidate information

Information supplied by NurtureEd about candidates is confidential.

Families must not:

  • Share candidate profiles unnecessarily;

  • Publish candidate information;

  • Use candidate information for unrelated purposes;

  • Forward candidate information to another family without NurtureEd's permission; or

  • Use information provided by NurtureEd to circumvent NurtureEd's placement fee.

10. Direct or indirect engagement

If a family engages a candidate introduced by NurtureEd without informing NurtureEd, the placement fee remains payable where the engagement falls within the introduction protection period.

This applies whether the candidate is engaged directly or through another person, company or intermediary.

11. Employment of candidates

NurtureEd is an introduction agency and does not ordinarily employ the candidates it introduces.

The family and candidate are responsible for establishing their employment or engagement relationship.

Families should obtain independent advice concerning their obligations as an employer where necessary.

12. Safeguarding

Families should notify NurtureEd promptly of any safeguarding concern arising during a placement where appropriate.

Where there is an immediate risk to a child, the family should contact the police, emergency services or the relevant safeguarding authority immediately.

NurtureEd may suspend or terminate a candidate's placement or registration where safeguarding concerns arise.

13. Liability

NurtureEd will exercise reasonable care in providing its recruitment and introduction services.

However, NurtureEd cannot guarantee:

  • A candidate's future conduct;

  • The continuation of a placement;

  • A candidate's performance after introduction;

  • That a candidate will remain available; or

  • That a placement will be successful for its entire intended duration.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

14. Complaints

Any complaint concerning NurtureEd's services should initially be sent to:

NurtureEd will consider complaints fairly and seek to resolve them within a reasonable period.

15. Data protection

NurtureEd processes personal information in accordance with its Privacy Policy.

The Privacy Policy explains how NurtureEd collects, uses, stores and protects personal information relating to families, candidates and children.

16. Governing law

These Terms are governed by the law of England and Wales.
